Texas Medical Board March 2009 Board Rules Changes

The following is a summary of the changes effective on March 9, 2009.

Chapter 162, Supervision of Medical School and Physician Assistant Student, with amendments to §162.1, Supervision of Medical Students, provides for the supervision of a medical student who is not enrolled at a Texas medical school as a full-time student or visiting student.

Chapter 171, Postgraduate Training Permits, repeals §171.7, Inactive Status, repeals a provision that recognizes an inactive status of a physician in training permit.


Chapter 172, Temporary Licenses, with amendments to §172.4, State Health Agency Temporary License, updates the reference to the board rule requiring the holder of a temporary license under this section to show that the person has taken an examination within the last ten years.

Chapter 175, Fees, Penalties, and Forms, amendments to §175.1, Application Fees, corrects fees charged for application for surgical assistant licenses and penalty fees for surgical assistants and physician assistants, and §175.3, Penalties, corrects penalty fees in accordance with statutory requirements.

Chapter 185, Physician Assistants, amendments to §185.2, Definitions, revises the definition of a supervising physician to define and “unrestricted medical license.”
Chapter 189, Compliance Program amendments to §189.1, Purpose and Scope, adds a citation to statutory authority authorizing the Board to promulgate rules regulated to the development of a program to monitor compliance of license holders who are subject to disciplinary action, and §189.2, Definitions, updates the names of the Texas Medical Board and the Texas Physician Assistant Board and adds chart monitoring to the definition of a monitoring physician.
