Mirena Uterus Perforation and Federal Consolidation

Many defective product liability and personal injury lawsuits have been filed over the Mirena intra uterine birth control device, in various State and Federal courts nationwide. Recently, a motion has been filed to consolidate all federal cases before one federal court for coordinated pretrial proceedings as part of an MDL, or multidistrict litigation.

Mirena IUD Perforation Allegations

All of the lawsuits involve similar complaints that the intra-uterine device (IUD), caused severe complications including perforating or puncturing the uterus, and migrating to other parts of the body. The motion to consolidate requested that all Mirena lawsuits be consolidated in the Northern District of Ohio.

Benefits of Mirena MDL

Consolidation is beneficial for pretrial proceedings, to reduce discovery, avoid conflicting pretrial rulings from different judges and to increase the processing of these injury claims. Consolidation is different from a class action lawsuit, in that the complaints would still remain individual actions, and each plaintiff must demonstrate that the Mirena IUD was defective and the cause of an injury.

Mirena IUD New Jersey State MDL Denied

As reported here earlier,the Supreme Court of New Jersey decided not to consolidate the Mirena litigation at the state level. Bayer, the manufacturer of Mirena is based in New Jersey and they requested consolidation in New Jersey, their home state.
