5,000 Cook IVC Filter Injury Claims

There are close to 5,000 personal injury and product liability cases filed against Cook Medical in the federal court system. Injured patients allege that Cook Celect, Cook Gunther Tulip inferior vena cava (IVC) filters were defectively designed and cause catastrophic injury in some cases.

The injury claims include migration, tilting of the filter, fraturing or breaking of the filter which leads to metal shards that can puncture the vein or move into vital organs including the intestines, heart and lungs.

Cook Federal MDL

The injury lawsuits have been centralized and coordinated before U.S. District Judge Young in the Southern District of Indiana as part of an MDL, or multidistrict litigation.

A small group of cases have been selected for a “bellwether” process, and early trial dates to determine the evidence and testimony in the litigation.

Cook Bellwether Verdicts

In November 2017, the first case was a defense verdict, and Cook prevailed in the second bellwether trial. In May 2018, a Texas jury awarded $1.2 million in damages, to a Houston firefighter whose Cook blood clot filter moved out of position and perforated his aorta, the largest blood vessel in the body.

Bard IVC Filter Injury cases

Cook is not the only IVC filter manufacturer under the gun. C.R. Bard is also a major manufacturer of these filters which are designed to prevent blood clots in the leg from travelling up to the heart and lungs, potentially causing death.

There are several thousand Bard Recovery and Bard G2 filter lawsuits in a separate MDL, which is centralized before U.S. District Judge Campbell in Arizona.

Bard Bellwether Verdicts

The first Bard IVC bellwether case resulted in a $3.6 million damges award, after the federal jury found that Bard recklessly disregarded the safety of consumers who received the filters.

But other bellwether trials ended in defense wins, the injured plaintiffs were unable to link their injuries to design defects with the IVC filter.
