J&J DePuy Pinnacle Metal Hip. On the heels of the latest plaintiff multi-million dollar DePuy hip trial verdict, Johnson & Johnson (J&J), the world’s largest pharmaceutical company and medical device maker, and its DePuy subsidiary were back in federal court again.

J&J DePuy Pinnacle Metal Hip. J&J and its DePuy unit are under fire over allegations involving its Pinnacle/Ultamet line of metal hip devices which are prone to metal poisoning and premature failure according to lawsuits.

J&J and its DePuy unit, which makes the artificial hips, recently argued in the Fifth Circuit Court of Appeals that the verdict should be reversed because there was insufficient evidence that the hips were defectively designed and deceptively marketed.

Johnson & Johnson, and its DePuy subsidiary are under fire over allegations involving its Pinnacle/Ultamet line of metal hip devices which are prone to metal poisoning and premature failure according to lawsuits.

A Texas federal jury slammed Johnson & Johnson and DePuy Orthopaedics Inc. unit with a combined $247 million verdict in the latest bellwether trial over DePuy’s Pinnacle line of metal-on-metal hip implants.

When metal hips are used in hip replacement surgery, patients can suffer from implant failure, metallosis, bone death, dislocation, and other serious complications.

Many patients experience relief from pain caused by osteoarthritis and increased mobility. But, like other surgeries, hip replacement carries its own set of risks and complications that require immediate medical attention or even additional surgeries to treat. The type of implant may also increase the risk for certain complications. For example, studies show metal-on-metal implants have greater risk of loosening or early failure because metal particles released from the device may weaken nearby bone and tissue.

Popular brands of metal-on-metal hip implants include Smith & Nephew, Biomet M2a-Magnum, and DePuy ASR and Pinnacle.

DePuy Orthopaedics is exposed to several thousand DePuy Pinnacle hip lawsuits, which allege defective metal hip design and early failure of the implant. The first federal bellwether trials for the metal-on-metal hip replacement system are set to begin in September 2014, in the Northern District of Texas in Dallas.

Amost 6,000 DePuy Pinnacle Lawsuits

On November 19,  in open federal court in Toledo, Ohio, Johnson & Johnson agreed to pay at least $2.475 billion to settle thousands of lawsuits over its recalled hip implants.

Today in open federal court in Toledo, Ohio, Johnson & Johnson agreed to pay at least $2.47 billion to settle thousands of lawsuits over its recalled hip implants. The agreement would settle about 8,000 U.S. suits against J&J’s DePuy unit brought by patients who have already had artificial hips removed. The company will pay an average of about $250,000 for each surgery and cover related medical costs.

Johnson & Johnson Under Fire from Lawsuits

The settlement is the second multibillion-dollar settlement this month for J&J. The company, agreed November 4 to pay $2.2 billion to resolve criminal and civil probes into the marketing of Risperdal and other medicines.

According to court documents, Johnson & Johnson has agreed to settle a DePuy ASR hip replacement lawsuit, on the eve of trial. The settlement agreement remains confidential.

Johnson & Johnson subsidiary DePuy Orthopaedics has agreed to settle a DePuy ASR hip lawsuit, the first bellwether trial in a California state court consolidation of ASR cases.

This DePuy ASR case that was set to begin later in October in California state court. See my earlier reporting on secret settlement negotiations regarding the DePuy ASR implants. This is overall good news for plaintiffs that the company is beginning to take the failure allegations seriously.

According to Johnson & Johnson (JNJ), it will stop selling metal-on-metal and ceramic-on-metal hip replacements because of a lower demand for the devices.This decision announcement was made in May 2013.

Metal liners in the Ultamet Metal-on-Metal Articulation and the Complete Ceramic-on-Metal Acetabular Hip System will no longer be available worldwide after August 31. J&J’s DePuy Orthopaedics unit will stop selling related products through 2014 to simplify and streamline its offerings.

A New York woman, Ann McCracken’s defective hip claim will be the first DePuy ASR hip lawsuit to go to trial in federal court.  McCracken’s case is a “bellwether” case, designed to determine how juries will respond to presented evidence and testimony.

7,800 Federal DePuy ASR Lawsuits

More than 7,800 lawsuits have been brought in the federal court system by folks who have problems with the recalled DePuy ASR hip implant. These metal on metal hip cases are consolidated as part of an MDL, or Multidistrict Litigation, which is centralized before U.S. District Judge Katz in the Northern District of Ohio.
